can I claim?

Road Accident

Accidents on the road occur every day. They happen to drivers, passengers, pedestrians, cyclists, and any other road user. Road accidents account for over 30% of all accidents where people sustain injuries. All car drivers and drivers of other vehicles must be insured against claims by people injured or suffering losses as a result of a road accident. A claim is made against the person who is to blame for the accident and normally their insurance company will pay damages to the injured person. Sometimes people are injured by uninsured drivers and in that case it may still be possible to recover damages from a government organisation called the Motor Insurers Bureau (MIB ).

As with all accidents you should normally bring a claim within 3 years of the accident but there can be certain exceptions to this rule like when the injured person was under 18 at the time of the accident. In that case the 3 years in which to bring a claim will run from the persons 18th birthday. It is best to make a claim as soon as possible so that your memory and the memory of any witnesses to the accident is fresh. Witnesses can include passengers in your vehicle ( even if they are members of your family ) as well as other people who saw what happened.

If you have been injured in a road accident and you are successful in you claim the your damages can include compensation for your pain and suffering, any lasting disability, any out of pocket expenses that you have incurred such as loss of earnings or hire charges , any future expenses that you will incur as a result of your injuries and other areas of compensation. We can advise you as to everything that you will be entitled to claim for and our sister company, Litigation Assistance Ltd will be able to help in obtaining the best evidence to support your claim.

If you have been involved in a road accident where somebody has been injured then the accident must be reported to the police.
